Yarmouth Planning Board advances short-term rental bylaw revision, endorses land sale plan
Planning Board · Meeting of May 20, 2026
Yarmouth Planning Board pushes short-term rental bylaw toward a second draft while raising alarm over state zoning legislation. At the May 20 meeting, the full seven-member board endorsed the $600,000 sale of a Nottingham Drive parcel to the town under a grant deadline of June 1, with attorney Michael Kennefic representing Kingsway Condominium Trust after Land Court revisions to the plan. Town Planner Kathy briefed the board on a UMass Donahue study finding that short-term rentals make up only 5 to 8 percent of Yarmouth's housing stock, "much lower than a lot of other communities who had to take some aggressive regulations." Members debated extending the bylaw's sunset clause, with Clerk Ken Smith arguing for a five-year window to allow flexibility as the lodging industry evolves, and Chair Joanne Crowley and Member Peter Slovak flagging that Yarmouth is now being actively marketed as a short-term rental investment destination.
The board also heard that provisions in the state environmental bond bill and FY27 outside sections could tie competitive grant preferences to the elimination of parking minimums and relaxed wetland standards, drawing objections from the Cape Cod and Islands Water Protection Fund; member comments on the short-term rental draft are due to town planner Kathy by May 27.
