Yarmouth Planning Board Strikes Short-Term Rental Occupancy Cap, Seeks State Legal Opinion

Yarmouth Planning Board advances short-term rental bylaw, frees long-held subdivision lot. The board voted unanimously to release Lot 7B at 63 Thatcher Shore Road in Yarmouth Port from its construction covenant, ending a subdivision process that began in 2005 and allowing owner Brian Bassler to apply for a building permit; civil engineer Dan Ojala of Down Cape Engineering called it "somewhat administrative at this point." Working through redline draft five of its short-term rental bylaw, the board struck a provision that would have capped daytime visitors at twice the maximum overnight occupancy, with Planning Director Kathy Williams warning that setting a numerical multiplier would give property owners "a false sense of the number of people they can have." The town currently has 826 registered short-term rentals, of which only 27 are held by LLCs. On the seasonal communities designation, Member Susan Brita pressed for a formal legal opinion from the Executive Office of Housing and Livable Communities on whether movable tiny homes can be prohibited through regulation, calling a March 30 email from a state senior policy analyst "not a legal answer." Town Counsel is scheduled for the August 5 meeting, and a Special Town Meeting is tentatively set for November 16, 2026.
