YARMOUTH — Conservation Commission denies river dock project despite state approval. The board unanimously approved Atlantic Coast Engineering's proposed pier at 104-110 River Street under Massachusetts environmental law but rejected it 0-6 under the town's Wetland Bylaw, citing four variances including excessive deck width, insufficient dock distance, and location on a property line, plus a negative recommendation from the Waterways and Shellfish Advisory Committee. Chair David Bernstein's state-law motion passed 6-0; Commissioner Elly Tierney's town-bylaw motion failed, resulting in denial.
The Commission also unanimously approved a stone revetment at 85 Merchant Avenue and a mixed-use building at 645 Route 28, and issued two certificates of compliance.
